Rules Regarding Acceptable Internet Use

NOTE: The subscription to an Internet Service entails on your part acceptance, without any restriction, of all the Terms and Conditions applicable to the Service.

1. Definitions

For purposes of presentation, the expressions and the terms described hereafter, unless the context indicates differently, have the following significance:

  • Supplier: designates Maskatel Inc.
  • The Customer: designates the holder of the Internet account or any other user of this account, whether it is used or not by the holder. The holder of the account is the only person responsible for use of the Service and the payment of all the expenses to the Supplier.
  • Rules: designates the Rules of acceptable use of the Service.
  • General Agreement of Service: designates the contract occurred between the Supplier and the Customer to give access to the Internet network.
  • Service: designates the residential or commercial Internet connection and the type of Service to which the Customer chose to subscribe to via the Supplier.
  • Internet Host: designates any computer or electronic device connected to Internet.

2. Introduction

In order to help the Supplier to protect the integrity of the Service and to allow its users to benefit fully from the Internet, the Customer agrees and accepts to respect the modality of the present Rules regarding acceptable Internet use ("Rules"). Any violation of these Rules constitutes a breach with the General Agreement of Service and can necessitate the termination and/or the suspension of the Service of the Customer.

3. General

The Customer is prohibited to use the Service or any equipment provided within the framework of the Service to operate a business as internet supplier, nor for any other activity that is not representative of the standards provided by the Service.

The Customer is also prohibited with to use the Service to engage in any activities, which include, without restriction on the general scope/range of the following:

• Usurpation of the identity of other subscribers of the Service or any other subscriber of Internet service in whatever way.

• To harass users or groups in any unspecified way.

• To compromise the operations or the effectiveness of the services or to cause an exceptionally large activity load on the networks of Internet provider.

• The use of resources of an Interne Host/a Hosting Server unauthorized by the administrators, including the posting or forwarding chain letters, multi-level marketing schemes, or whatever other prohibited materials. Using the services to make fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam such as "pyramid schemes".

• Posting or transmitting any information or software, which contains a virus, a "cancelbot", a "Trojan horse", a "worm" or all other harmful disturbing components.

• To falsify or eliminate all/any copyright, all/any denunciation legal or otherwise, any designation of property ownership or any label identifying the origin or the source of a software or other material contained in a file or other data.

• To download, upload, to transmit, post, diffuse, disseminate, receive and store, recover or reproduce in any unspecified ways, to distribute, or reach by any other means a software or any literature/material:

- That promotes or encourages any illegal activity or content that can lead to a civil action suit.

- That, which is defamatory or obscene, contains juvenile pornography or heinous literature.

- That, which constitutes an attack on private life, an appropriation of the personality or the establishment of a link or an unauthorized framing/gain unauthorized access. Use of any program, utility, or file that can be used to gain unauthorized access.

- That, which is confidential, protected by copyright or all other rights of intellectual ownership, without to have obtained the authorization of the respective holder / owner of these rights.

- That, which allows the reproduction, distribution or any other means of gaining information, software or any other data/material.

- That, which is configured to help the user to thwart against copy, recording or all other anti-theft protection mechanism device associated with commercial types programs or shareware.

- Designed to help the fraudulent use of telecommunications services.

- Designed to transmit unsolicited mail messages, at the sole discretion of the Supplier, cause significant interruptions or give rise to complaints by the other users.

• No respect for any law or applicable regulation.

The Supplier will not tolerate abusive behaviour or language against any with regard to the employees of the suppliers and the agents and representatives of the Supplier.

4. Email

The email service of the Supplier, as described in the Service Agreement, was designed for the Customer's personal use. Under the license, the Customer cannot distribute, transfer or sell the email service or any of his components belonging to the Supplier

The Customer acknowledges the use of email service from the Supplier consists in sending and receiving messages and suitable material. As noted above the general information applies entirely to the use of the email.

Any use of email lists in bulk "opt-in" (free-participation) is prohibited, unless having obtained a written authorization from the Supplier to this end.

The Supplier reserves the right, at any moment and without notice, to communicate any information in its view and sole discretion is necessary for the respect of all applicable laws, regulations, legal process or governmental request. The Supplier also reserves the right, at any time, to edit, refuse to post or remove any information or material, in whole or in part left entirely to its the discretion.

5. IRC conversation/Chatting

The Customer recognizes that it is strictly prohibited to use a chatting IRC service or any other service, which can cause inconvenience, or damage and/or attacks of any harmful components.

6. Network/Safety

In addition to the described general information noted above, the service prohibits the Customer to undertake activities which include, but are not limited to:

• The sharing of ones username and password for whatever reason, for ones account, including for purposes of simultaneous communication entries by access to dialup from the same account.

• To incapacitate the Internet Host from responding to the requests for service from other hosts.

• Exploit and/or lodge server applications, including, but are not limited to, HTTP, POP, SMTP, Proxy/SOCKS and NNTP.

• Analyze or hack the security mechanisms of an Internet Host.

• Falsify any part of the TCP/IP package heading information in whatever way.

• Any act which could compromise, in whatever way, the safety of the Supplier of the Customer.

As described in Agreement, the Customer is the only one responsible for the safety of his system and his account. The Supplier will give its full support with any police investigation for failure to comply with these rules.

In the event where the Supplier or the members of his personnel would receive numerous complaints about one or several infringements to the present rules, service charges for complaints received, in addition to administrative expenses, at the discretion of the Supplier, could be carried to the account of the Customer.
